The seller and contracting party is Tavolon Intelligence Co., Limited. Manufacturers, distributors and logistics partners may only handle fulfilment and shipping.
§ 1Scope and contracting party
(1) These General Terms and Conditions apply to orders placed through the online shop ml24.shop.
(2) The operator of the online shop and the customer's contracting party is:

(3) Tavolon Intelligence Co., Limited sells the products offered via ml24.shop in its own name and for its own account, unless expressly and legally effectively stated otherwise in the respective offer.
(4) Manufacturers, distributors, suppliers, logistics companies or other fulfilment partners may be engaged for storage, packaging and shipping. This does not change the customer's contracting party.
§ 2Customers
(1) The offer is directed at both consumers and business customers, unless stated otherwise in the respective offer.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
(3) A business customer is a natural or legal person or a partnership with legal capacity that, when concluding the contract, acts in the exercise of its trade, business or profession.
§ 3Conclusion of contract
(1) The presentation of products in the online shop does not, as a rule, constitute a binding offer to conclude a purchase contract.
(2) The customer may add products to the shopping cart and review and correct their entries before placing the order.
(3) By clicking the order button marked accordingly in the checkout, the customer places a binding order for the products contained in the shopping cart.
(4) After the order has been received, the customer receives an electronic confirmation of receipt. The purchase contract is concluded upon express acceptance of the order by Tavolon Intelligence Co., Limited or, at the latest, upon dispatch of the goods, unless stated otherwise during the ordering process.
§ 4Prices and payment
(1) The prices stated on ml24.shop at the time of the order apply.
(2) Taxes, shipping costs and other mandatory additional costs are displayed to the customer before the order is placed, in accordance with statutory information requirements.
(3) The available payment methods are displayed during the ordering process.
(4) The due date and the time of debiting depend on the payment method selected and the conditions stated there.
§ 5Delivery and fulfilment
(1) Delivery may be carried out by Tavolon Intelligence Co., Limited itself or by commissioned manufacturers, distributors, suppliers or logistics partners.
(2) Direct delivery by such a partner does not change the customer's contracting party.
(3) Delivery areas, shipping costs and estimated delivery times are stated in the shop or at the latest during the ordering process.
(4) Where several products are ordered, separate shipments are permitted provided this is reasonable for the customer and does not result in unjustified additional costs.
(5) If an ordered product is unavailable, the customer will be informed. Payments already made for goods that cannot be delivered will be refunded.
§ 6Deliveries from third countries
(1) Depending on the product, the storage location and the delivery destination, goods may be shipped from a country outside the European Union.
(2) Where additional import duties, import VAT, customs charges or comparable public levies may apply, the customer will be informed accordingly before placing the order, in line with statutory information requirements, insofar as these costs are not already included in the total price stated.
(3) No mandatory additional costs known at the time the contract is concluded will be imposed on the customer retrospectively without the customer having been duly informed beforehand.
§ 7Right of withdrawal for consumers
Consumers are generally entitled to the statutory right of withdrawal for distance contracts. Details, deadlines, exceptions and the model withdrawal form can be found in the separate withdrawal policy on ml24.shop.
§ 8Returns
(1) In the event of an effective withdrawal, the statutory provisions and the separate withdrawal policy apply.
(2) The customer receives the relevant return instructions for the specific return case.
(3) Returns should not be sent without prior agreement to a sender, manufacturer or fulfilment address stated on the shipping package, unless that address has been expressly confirmed as the return address. The consumer's statutory rights are not restricted by this.
(4) The consumer bears the direct cost of returning the goods in the event of a withdrawal only if they were duly informed of this before the contract was concluded and no other agreement applies.
(5) Rights in respect of defective goods remain unaffected.
§ 9Liability for defects / warranty
(1) The statutory rights regarding defects apply to the goods sold.
(2) The customer's statutory claims are directed against Tavolon Intelligence Co., Limited as the seller.
(3) An additional manufacturer's or dealer's guarantee exists only where expressly stated for the respective product. Such a guarantee does not limit statutory rights regarding defects.
§ 10Software, updates, licences and digital content
(1) Supplementary product-specific conditions may apply to software licences, updates, activation codes and other digital content; these will be pointed out before the order is completed.
(2) Information on term, compatibility, scope of functions, activation and any manufacturer accounts required can be found in the product description.
(3) In the case of digital content, a statutory right of withdrawal may expire prematurely only under the statutory conditions. Where express consent and the consumer's acknowledgement of the loss of the right of withdrawal are required for this, these must be duly obtained and documented before performance of the contract begins.
§ 11Retention of title
The delivered goods remain the property of Tavolon Intelligence Co., Limited until payment has been made in full, insofar as this is permitted under the law applicable to the contract.
§ 12Liability
Tavolon Intelligence Co., Limited is liable in accordance with mandatory statutory provisions. These Terms and Conditions do not limit or exclude liability for intentional conduct, for mandatory consumer rights or for any other liability that cannot be limited by law.

§ 14Applicable law
To the extent permitted by law, the contractual relationship is governed by the law of the Federal Republic of Germany. Vis-à-vis consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
§ 15Final provisions
Should individual provisions of these Terms and Conditions be or become wholly or partly invalid, the statutory provisions and the validity of the remaining provisions remain unaffected. Mandatory statutory consumer rights remain unaffected in any case.
